Who Pays the Doctor Bill If Your Caregiver Gets
Hurt?
When families privately hire home care providers to assist loved
ones with nursing care, personal care, companionship or
housekeeping, the law considers this an
employee/employer relationship. According to the
National Private Duty Association, most homeowners and
caregivers are not aware of this law.
If a private caregiver is hurt while working in the home,
most homeowner’s insurance policies exclude coverage of
the injury. This can lead to financially devastating
consequences to the homeowner and caregiver. Therefore,
it is important that consumers be careful when choosing
a home care provider.
“The benefits of hiring a quality Home Health Care
Agency are great. The agency will train, supervise and
ensure that you have the coverage that is needed.
The agency also insures and bonds their employees.” said Diane
Johnson, RN, BSN, JD, President of VIP Homecare Inc. in
Akron. “By hiring a home care agency, the consumers, especially frail
seniors, are at less risk for physical, psychological and
financial abuse. If the private caregiver doesn't show
up or calls off, the consumer is stuck. With an agency,
they another caregiver in their place.”
There are four types of home care providers:
• Home Care Agency
• Employment Agency
• Registry/Broker
• Independent Contractor
The Home Care Agency is the only one that accepts
responsibility for screening, training, insuring and
supervising their staff. With this in mind, it is
important for families to choose home care providers
that actually hire their employees. This provides the
assurance that qualified caring people are taking care
of their loved ones and offers financial protection, as
well.

health care providers call VIP Homecare, Inc. at
